SEEKING RELIEF—AND AN ATTORNEY WHO WOULD LISTEN
When Monzell Lewis was a victim of a moderate impact automobile accident in 2000, he seriously re-injured his back. The old back injury had improved greatly over time and he had been able to return to almost all physical activities. But after this auto accident, his back worsened and eventually Lewis required surgery to relieve the pain.
Despite his extensive injuries, Lewis found that attorneys weren't willing to take his case.
"They told me I didn't have a case because the damage to my car wasn't that bad, and that it would be hard to prove that my new back problems were caused by the accident. It was very discouraging," he said.
A recommendation from a cousin prompted him to call Jim Hailey at SGB who, after reviewing Lewis' medical records from both before and after his accident and meeting with him to hear the details of his story, agreed to take the case. SGB then began communicating with the insurance companies involved and provided them with the information and opinions needed to understand how and why Lewis' injuries had been caused by this accident. The ultimate result was settlement for the insurance policy limits.
"Because of the moderate damage to the car, we knew that insurance claims adjusters would be likely to view the claimed injuries as more serious than could be accounted for by the impact," recalled Hailey. "But the serious worsening of his back problem was caused by this accident. The key was putting together the proof showing he was in very good physical condition for months before the accident. It took time to really understand his pre- and post-accident conditions and time to put that information together in a persuasive way. But without taking the time one simply cannot evaluate the merits of the case and explain it to insurance companies. We showed the insurance company that it would be a better business judgment to pay the claim than take it to court."
"What impressed me most was their accuracy and their strategy," Lewis said. "They seemed to know what the other side was going to do before they did it. Everything they said was going to happen, did. I had a lot of faith in them and they didn't let me down."
