OWENS V. BETHLEHEM CONSTRUCTION, PREVAILING WAGE CLASS ACTION
SGB, along with co-counsel Robblee Detwiler & Black, have filed a class action lawsuit in King County Superior Court, Washington, alleging that Bethlehem Construction, Inc. failed to pay the proper prevailing wage to ironworkers, carpenters, and laborers who worked for BCI on Sound Transit’s Central Link Light Rail project. Rather than paying these workers at the construction trades rates of pay, BCI paid them at the much lower precast concrete rate of pay.
The case is currently pending before the Honorable Jay White. This case was certified as a class action on May 20, 2011, and Judge White granted summary judgment on liability to the plaintiffs on March 23, 2011. The parties reached a proposed class-wide settlement of the case on February 28, 2012, and the court granted final approval on August 24, 2012. Checks totalling $3.75 million were mailed to employees on October 15, 2012. Class members have 180 days from the date of issuance to cash these checks.
