PELLINO V. BRINK'S INC., CLASS ACTION FOR FAILURE TO PROVIDE REST AND MEAL BREAKS
SGB has filed two class action lawsuits against Brink’s Incorporated in King County Superior Court, Washington, for failure to provide Washington-based armored car messengers and drivers with legally required rest and meal breaks.
Following a four week bench trial, Judge Michael Trickey found in favor of the messengers and drivers in Pellino v. Brink’s and entered a judgment of almost than $1.3 million in March 2010. This judgment covered employees for the time period from April 2004 through October 2007. On November 7, 2011, the Washington State Court of Appeals affirmed the judgment of the trial court in favor of the class, and on December 22, 2011, the Court denied Brink's Motion For Reconsideration. Brink's has now satisfied the judgment and checks have been sent or delivered to all class members.
After Judge Trickey’s ruling in Pellino, SGB filed a follow-up lawsuit, Boyd v. Brink’s Incorporated, to obtain compensation for missed rest and meal breaks from November 2007 to the present. That lawsuit is currently pending before Judge Carol Schapira in King County Superir Court . Discovery is ongoing, no class has yet been certified, and trial is currently scheduled for February 10, 2014.
