PIERCE V. HEATH CONSULTANTS, INC., UNPAID DRIVE TIME CLASS ACTION
SGB has filed a class action lawsuit against Heath Consultants, Inc. on behalf of Washington-based employees for failure to pay drive time in company vehicles between employees’ homes and their first and last job sites of the day. This case builds on SGB’s success in Stevens v. Brink’s Home Security, Inc., in which the Washington Supreme Court held that workers who are dispatched directly from their homes to their job sites in company vehicles must be paid for their travel time under Washington law.
On June 28, 2011, the Federal District Court in Seattle, Washington, dismissed plaintiffs' claim on defendant's motion for summary judgment and dismissed plaintiffs' motion for class certification as moot. Plaintiffs initially appealed that decision to the Ninth Circuit Court of Appeals, but have voluntarily dismissed their appeal, ending the case.
