COBB V. KEHE FOOD DISTRIBUTORS, INC., CLASS ACTION FOR FAILURE TO PAY OVERTIME
SGB has filed a class action lawsuit in federal district court in Seattle, Washington, alleging that Kehe Food Distributors, Inc. improperly failed to pay overtime to merchandisers and certain sales representatives employed by Kehe. The lawsuit alleges that Kehe improperly classified these employees as exempt from overtime under the Washington Minimum Wage Act and the federal Fair Labor Standards Act. The lawsuit potentially covers all merchandisers employed by Kehe nationwide and sales representatives who worked for Kehe predominantly in Albertson’s supermarkets in the Intermountain/Pacific Northwest region..
The case is pending before the Honorable James L. Robart. On September 27, 2011, Judge Robart ruled that the case could proceed as a collective action under the Fair Labor Standards Act and as a class action under the Washington Minimum Wage Act.
