How to Help Your Product Liability Case
If you are considering taking legal action due to a defective medical device, product recall or drug reaction, there are several things you can do to help your case.
It is important to keep all packaging and other materials you received when you first received the product. This should include copies of special handouts or consent forms. If you believe you have been harmed by a medication, save any instruction or warnings you received from the pharmacist in addition to the package and inserts.
Keeping a log can also be helpful. For instance, if you now suffer from inflammatory bowel disease, keep a list of the medical appointments, treatments and the medications you must take to keep your condition controlled. Document when you first noticed any symptoms and how the condition has affected your daily life.
In the case of a product failure, like a stroller, take pictures of the condition of the item and try to keep it in the same condition until you have spoken with an attorney.
