SHROLL LITIGATION UPDATE AS OF JUNE 5, 2008
  
We are in the homestretch! The Settlement Administrator is in the final stages of calculating the back pay awards for over 14,000 class members. A painstaking review of the eligibility of all potential class members has been completed, and all challenges raised by potential class members have been resolved. The final stage (which is now ongoing) involves the calculation of back premiums owed to the Department of Retirement Systems and, in some cases, the calculation of back benefits owed to retired class members. Representatives of the Department of Personnel and the Department of Retirement Systems are diligently working on this project which is expected to be completed in the near future. 

While we can give no date certain for the final distribution of settlement awards, it is hoped and expected that such distribution will occur this summer.

SHROLL SETTLEMENT UPDATE AS OF FEBRUARY 15, 2008

Substantial progress has been made.
It is expected that the review of all challenges to the payroll histories accompanying the Second Notices will be completed very shortly. This has been a very complex task which involved careful review of employment records, both in paper form and on multiple electronic databases, for over 100 class members who filed challenges.

As soon as the challenge review is complete, the calculations of back pay awards owed to approximately 14,470 class members will begin. These calculations are also complex requiring, among other things, careful allocations to the retirement systems as well as tax withholdings.

No definite date has been set for the mailing out of the back pay awards, but the Settlement Administrator continues to work diligently, with the active assistance of the State Department of Personnel, to complete all necessary work as soon as possible.
